Notice of Violation (NOV) of the Georgia Rules for Safe Drinking Water (Rules) 391-3-5-.18 and Title 40 of the Code of Federal Regulations (CFR) 141.62 for the Lee County Water System, in Lee County, a Community Water System. During a review of sample analysis results, the Environmental Protection Division (EPD) has determined that Lee County Utilities Authority Water System exceeded the maximum contaminant level (MCL) for Fluoride. The maximum contaminant level for Fluoride is 4.0 mg/L, which is based on a Running Annual Average (RAA) for the sample results over 4 quarters. The Lee County Utilities Authority Water System exceeded the MCL for Fluoride at entry point 310 during the third quarter of 2025 (07/01/2025-09/30/2025) with a RZZ of 7.5 mg/L.

The Environmental Protection Division has reviewed the proposed Corrective Action Plan (CAP) for the referenced violation. Based upon the information submitted, the steps detailed in the CAP may prove effective in addressing the Fluoride MCL violation at the Lee County Utilities Authority Water System.

The approved CAP consists of moving the sampling point further downstream from the chemical feed injection point and adjusting the chemical feed rate, which was completed on September 19, 2025. Please note that the new sampling point must meet the definition of “entry point” according to the Georgia Rules of Safe Drinking Water. The entry point is defined as a sample location anywhere on the finished water line after treatment, up to and including the first service or customer tap.
